Maternity Leave Frequently Asked Questions:
 

1.      When does my maternity leave start?

a.      Your maternity leave begins the day in which your baby is born.

2.      When does my maternity leave end?

a.      Your maternity leave ends when you are medically cleared by a doctor. A doctor’s note is required and will need to be sent to Amy Rogers at arogers@mwcsd.org.

3.      If my doctor takes me out of work prior to my due date/having my baby, does that time count towards my leave 

a.       No. This time does not count towards your leave. You will need to use sick time for this, which could potentially impact your paid leave due to the amount of sick time you have accrued.

4.      Can I be paid during my Maternity Leave?

a.      Yes. You can be paid for up to 8 weeks IF you have enough sick time accrued at the time of the leave and your situation calls for the additional medical time off. There would need to be a doctor’s note to extend the 8-week leave.

b.      If the leave extends beyond the 6–8-week time period, you will go into unpaid time.

5.      Can I be paid through NYS Disability?

a.      No. School districts are not required to be a part of disability per New York State.

6.      What happens to my health insurance during my leave?

a.      If you have insurance with the district, you will remain covered by the insurance for up to 12 weeks per the family medical leave act (FMLA). After 12 weeks, you will be required to pay the cost of the insurance.

b.      Family Medical Leave Act does not apply to dental insurance.  Once you end the medical leave the employee is responsible for the full cost. After all your sick days are used and you enter an unpaid status you will be responsible for the full cost of your dental insurance. 

7.      What happens to my tenure and seniority during my leave?

a.      During a leave of absence, you will not accrue any tenure/seniority within the district for your position during the unpaid portion of the leave. If you are using sick time within the 6-8 week period, that will count towards tenure/seniority.
 

 8.       Can I work and be paid by the school district during my maternity leave?

a.      No. We recommend that you write the last contractual day of school for employee’s school year as the end of the maternity leave. This allows you to work and be paid for summer professional development.

9.      What if my baby comes early?

a.      If your child is born early, we may need to adjust your maternity leave based on this timing. Please contact the district office at your convenience to help us update your maternity leave plan.

10.  Can I use HSA money to pay for medical bills from my hospital stay (High Deductible Plan Only?

a.      Yes. This is an appropriate way to use your HSA money if you have the HDHP.

 Things to Do:

1.      Submit Letter to Superintendent requesting the maternity leave using the dates from above.

2.      Keep us up to date at your convenience with the birth of your child to ensure the transition to and from the leave goes smoothly.
